The Hamilton Police Department terminated Officer Brian DiBiasi's employment on January 31 following accusations of using a messaging application to share "image and video files of suspected child sexual exploitation and abuse material," as stated by NJ Attorney General Matt Platkin.
Officials initiated an investigation into Brian DiBiasi, 39, and his spouse Elizabeth DiBiasi, 42, a Mercer County Sheriff's Office officer, after receiving notification from the National Center for Missing and Exploited Children about the questionable images. The couple was taken into custody on January 29.
According to authorities, DiBiasi distributed 36 media files containing nude images and recordings of his wife with children present. Officials accessed chat records where DiBiasi allegedly "mentioned children being present while he and his wife had sex," Platkin stated.
The charges against him include allowing a child to be present during a sexual act that could be photographed, filmed or reproduced; engaging in sexual behaviour that would corrupt a child's morals; possession of fewer than 1,000 images of child sexual abuse; distribution of child sexual abuse images; and possession of child sexual abuse images with intent to distribute.
Elizabeth DiBiasi faced charges related to inappropriate sexual behaviour with a minor that could corrupt the child's morals.
"Sexual offenses against children are among the most serious crimes we charge," Platkin said. "It's especially disturbing when, as in this case, the accused are members of law enforcement.
"Protecting children from this kind of lasting harm is one of our most important responsibilities," he added.
Hamilton's Mayor Jeff Martin issued a statement regarding DiBiasi's removal from service.
"These actions are not only abhorrent but have also shaken our community's sense of security and trust in those who are sworn to protect us," Martin wrote. "While those feelings are understandable, let me be clear: the despicable actions of these individuals do not define our community or the dedication and integrity of the men and women who serve and protect us every day."
The current employment status of Elizabeth DiBiasi remained uncertain.
