According to report in Free Press Journal, the actor approached Bhopal's Commissioner of Police, Harinarayanachari Mishra, on Wednesday, submitting a written complaint against Smita Gate. Nitish in his complaint stated that after twelve years of marriage, both he and Smita had mutually filed for divorce in 2018 at the Mumbai family court. However, their divorce case is still pending. Nitish accused Smita, who currently holds the position of Additional Chief Secretary at the MP Human Rights Commission in Bhopal, of preventing him from meeting their twin daughters, Devyani and Shivranjani.

In his complaint, Nitish detailed how Smita allegedly obstructed his access to their daughters by frequently changing their schools. This, he claimed, had a detrimental impact on his mental well-being. Nitish appealed to the Bhopal CP to intervene in the situation and facilitate his meetings with his daughters.

The Commissioner of Police confirmed to Free Press Journal of receiving Nitish Bharadwaj's application and assigned Investigating Officer Phalguni Dixit to look into the matter. This indicates that the authorities are taking the complaint seriously and are initiating an investigation.

Nitish Bharadwaj and Smita Gate got married in 2009 and are parents to twin daughters. However, after twelve years of marriage, they decided to part ways and filed for divorce in the Family Court in Mumbai in September 2019. Despite the legal proceedings, the issue regarding their daughters' custody and access remains unresolved, leading Nitish to seek intervention from the police.
