CAS defers decision on Vinesh Phogat's appeal against disqualification till August 13

The ad-hoc division of the Court of Arbitration for Sport (CAS) will take some more time to deliberate on Indian wrestler Vinesh Phogat's appeal against her disqualification from the women's 50kg free-style final of the Olympic Games and will announce its decision only on August 13.

The 29-year-old was disqualified for being 100gm overweight at the time on weigh-in on Wednesday. The much-anticipated verdict on her appeal was earlier due to be announced this evening.

However, in a chaotic turn of events, the Indian Olympic Association first stated that the verdict will be out on Sunday before issuing a clarification to say that the outcome will be known only on August 13.

"The ad-hoc division of CAS has extended time for the Sole Arbitrator Hon. Dr Annabelle Bennett in the Vinesh Phogat vs. United World Wrestling & the International Olympic Committee matter to give a decision till 6-00 p.m. on August 13, 2024," the IOA statement read.

"The reference to August 11 in the earlier communication sent by me was to the time given to all parties to present any additional documents before the Sole Arbitator," it added.

The body apologised for "the confusion and inconvenience caused".

The Games will close on Sunday with a ceremony at Stade de France, which was the venue for track and field events.

The CAS ad-hoc division, set up especially for dispute resolution during the Games, had accepted Vinesh's appeal against her ouster on Friday.

The Indian has demanded that she be given a joint silver with Cuban wrestler Yusneylis Guzman Lopez, who had lost to Vinesh but was later promoted to the final following the Indian's disqualification.

American Sarah Hildebrandt won the gold after defeating Lopez in the title clash.

Vinesh was represented by high-profile senior advocates Harish Salve and Vidushpat Singhania.

Crestfallen after being disqualified, the wold championships bronze-medallist announced her retirement on social media.

The United World Wrestling has already made it clear that it was not in favour of making an exception for her although it could consider reforms in rules at a later time.

The International Olympic Committee (IOC) president Thomas Bach held a similar view.

India signed off with six medals at the Games, one silver and five bronze, two of which came from pistol shooter Manu Bhaker. The lone silver was snared by Neeraj Chopra, who was the defending champion in men's javelin throw.

Aman Sehrawat, after losing in the men's 57kg wrestling semifinal on Thursday, was 4.5 kilograms over the permissible weight limit (61.5kg) but guided by his Indian coaches, he successfully shed the excess weight within 10 hours, enabling him to compete for and win the bronze medal on Friday.

Working relentlessly overnight, the Aman's team ensured that he met the weight criteria, thus avoiding a potential disqualification.

Star javelin thrower Neeraj Chopra is keeping his fingers crossed for wrestler Vinesh Phogat as she awaits a verdict on her appeal against disqualification from the Games but at the same time, he is also hoping that "people don't forget what she did for the country" if the decision is not in her favour.

"If she gets the medal, it would be very good. If things had not panned out the way they did, she would have had the medal. I hope she gets it because if you don't have it around your neck, that thing stays in your heart," the 26-year-old Chopra said.

"Today people might say that she is our champion but they will forget after a few days. Agar aisa na hota, a medal wouldn't have mattered. So, I hope she gets the medal. I just hope whether she gets the medal or not, people don't forget what she did for the country," he said.

Vinesh was found 100gm overweight before her 50kg category final on Wednesday and she has appealed against her disqualification in the ad-hoc division of the Court of Arbitration for Sport here. A decision on the appeal is expected to be delivered by 9.30pm IST.

The 28-year-old, also a silver medallist at Rio, missed his home Games in Tokyo after he was found to be 50gms above the limit on the day of competition in an Olympic qualifier.

After winning the men's 57kg gold on Friday Higuchi said, "Fifty-seven kgs for an adult man, it's hard to maintain because if you overeat even a little bit, you have to change your weight category."

Most wrestlers compete in a category below their natural weight to fight a weaker opponent and while the reward is huge, the process is brutal as well as risky.

International Olympic Committee (IOC) president Thomas Bach on Friday said he has a 'certain understanding' for Vinesh Phogat, who has challenged her disqualification from Olympic finals in the Court of Arbitration for Sport (CAS), but also wondered where would one draw the line after allowing small concessions in certain situations.

"I must say, I have a certain understanding for the wrestler; it's clearly a human touch," said Bach, during an IOC media conference here.

"Now, it's (appeal) in CAS. We will, at the end, follow the CAS decision. But, again, the international (wrestling) federation, they have to apply their interpretation, their rules. This is their responsibility," he added.

Asked if two silver medals could be awarded in a weight category, Bach said, "No, if you ask in such a general way. But allow me to comment on this individual case.

"There the regulations of the international federation have to be followed and the international federation, United World Wrestling (UWW), was taking this decision."

Bach said a 100gm overweight may not sound much to a layman but asked would such a relaxation would apply to a track event where results are sometimes decided by one thousandth of a second.

"Looking at the federation or anybody to take such a decision, when and where do you make the cut? Do you say with 100gms, we give it but with 102(gms), we don't give it anymore?

"What do you do then in sports where you have differences of one-thousandths of a second (in track events). Do you also then apply such deliberations?," he added.
