Key highlights of the bill

Valid travel documents are mandatory: Anyone entering or leaving India must have a valid passport and visa. Unauthorized entry could lead to imprisonment of up to five years and fines of up to INR 5 lakh.

Strict penalties for forged documents: Using or supplying fake travel documents will now come with severe punishments—jail time of two to seven years and fines ranging from INR 1 lakh to INR 10 lakh.

Crackdown on overstaying: Foreign nationals who overstay their visa or violate visa conditions could face up to three years in prison and fines reaching INR 3 lakh.

Mandatory reporting by institutions: Hotels, schools, hospitals, and other establishments that accommodate foreign nationals must report their presence to immigration authorities. This will help monitor individuals who overstay their visas.

Transport carriers held accountable: Airlines, shipping companies, and other transport operators must verify that passengers have valid travel documents. If they fail to do so, they could face fines or even have their vehicles seized.

National security comes first: Authorities now have the power to deny entry or cancel visas for individuals deemed a threat to national security, public order, or India’s sovereignty.

Merging old laws for simplicity

The bill consolidates and replaces four outdated laws to create a more streamlined immigration process:

The Passport (Entry into India) Act, 1920

The Registration of Foreigners Act, 1939

The Foreigners Act, 1946

The Immigration (Carriers' Liability) Act, 2000

By merging these laws, the government aims to simplify regulations, reduce bureaucratic hurdles, and enhance ease of doing business.
