Not just penetration, the Meghalaya High Court has ruled that even rubbing male organ over a woman’s underpants is
rape!
On March 14, a division bench comprising Chief Justice Sanjib Banerjee and Justice W Diengdoh, was quoted as saying:
"In any event, by virtue of Section 375 (c) of the Penal Code, when a person manipulates any part of the body of a woman so as to cause penetration into, inter alia, the vagina or urethra, the act would amount to rape.
The Rubbing male organ even over underpants is RAPE: High Court judgementere is sufficient evidence of such penetration in the present case."
This was said in reference to an incident of rape on 23 September, 2006.
In 2018, on 31st October, a trial court had put the accused in 10 years of imprisonment in addition to Rs 25,000 fine. However, the convict challenged the order in high court with an excuse that he had not penetrated the victim do how was it rape, as per a report by IANS.
The high court refused the claim and said that the 10-year-old victim has clear signs of injuries of assault after medical examination.
"Since the victim was a minor and since the appellant confessed that he lost control over himself and committed the offense, the punishment awarded to the appellant herein does not appear to be out of place," the court further said.
