That's what happened to a 32-year-old woman who applied for a divorce, and the Jharkhand High Court finally granted it citing years of mental cruelty from her husband. The court's powerful ruling - "Once trust and respect are destroyed, the marital bond cannot survive" - emphasised on this important truth: Psychological torment destroys marriages just as physical violence does.



A wedding that turned into a nightmare

Married in 2020, the woman's troubles began almost immediately. While she slept, her husband secretly accessed her phone, discovered photographs from a pre-marriage relationship, and transferred them to his device. What followed next was simply brutal and social humiliation. The husband showed these images to his family members, who then taunted her relentlessly in her own marital home.




"Character assassination by her own husband," the Division Bench declared hearing the case. The husband even threatened to post the photos online, holding her past over her like a sword. This wasn't marital disagreement - it was psychological cruelty.

The Court's powerful stand: Mental cruelty IS cruelty The family court initially rejected her 2023 divorce plea, but the Jharkhand High Court saw clearly.

“By showing those objectionable photographs to his family members by the respondent-husband and on the basis of that she was being humiliated by the family members of the respondent-husband, which is nothing but the character assassination of the wife by her own husband,” the Bench said, reported MoneyControl.

"Cruelty isn't just physical," they ruled. Mental agony that makes cohabitation impossible qualifies under Section 13(1)(i-a) of the Hindu Marriage Act. Talking about marriage being a sacred relationship, the Bench further said, “Relationship of wife and husband is based on the trust and respect to have upon each other and if it is broken it is non-repairable as the trust is the foundation of marriage. Marriage is a relationship built on mutual trust, companionship and shared experiences.”

Why this Court hearing mattersIndian women often silently suffer in their marriage, fearing divorce stigma or financial dependence. But this particular decision validates that:
