The Madhya Pradesh HC’s recent observation that ‘constitutional rights need not always be enforced’ is not only deeply regressive but does a disservice to our judicial system
The “youngsters” in the case were two 19-year-old consenting adults who approached the court seeking police protection, but ended up being a subject of ridicule. Not only was their right to exercise choice questioned, but their constitutional freedoms were gravely trivialised and belittled even as the Supreme Court has time and again upheld the legality of live-in relationships.
