Why despite SC’s ‘bail not jail’ views, the likes of Umar Khalid are still stuck

Time and again, the Supreme Court has emphasised the need to protect personal liberty and held that the right not to be denied reasonable bail without just cause is an essential element of an enlightened criminal justice system.
The most recent comments came less than a week ago when it asked all high courts to expeditiously dispose of all regular bail and anticipatory bail applications of accused persons, saying it involved the personal liberty of citizens guaranteed under Article 21 of the Constitution.
