We’re overcautious while using AI in judiciary, says CJI

NEW DELHI: Supreme Court on Friday allayed fears of hasty integration of artificial intelligence (AI) with the justice delivery system and said it is over cautious in using AI in the judiciary.

A PIL petitioner, through senior advocate Anupam Lal Das, told a bench of CJI Surya Kant and Justice Joymalya Bagchi that there had been instances of AI prompting wrong judgments and even conjuring fictitious judgments which unsuspecting lawyers cite before courts creating a possibility of judges getting misled into giving a wrong decision.


When Das said there should be structured integration of artificial intelligence in the judiciary, the CJI said, “We have adopted a very overcautious approach for use of AI in justice delivery system and courts. We do not want AI or machine learning tools to overwhelm judicial decision making.”

“As this issue cannot be examined on the judicial side. We are holding discussions with domain experts. It is also required that all lawyers verify the veracity of AI prompted case laws prior to their citing before a court of law during arguments in a case,” CJI Kant said.
