Triple talaq victim attacked with acid for moving SC
NEW DELHI: The Supreme Court on Friday sought the UP government’s response to a Muslim woman’s plea for security after she was allegedly attacked with acid by her in-laws for moving the apex court to challenge polygamy and nikah halala after her husband ended their marriage through the now banned triple talaq.
A bench of CJI Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud asked Ashwini Upadhyay, counsel for Rani aka Shabnam, to give a copy of her petition to UP’s additional advocate general Aishwarya Bhati and posted the matter for hearing on September 17.

He said Shabnam, a resident of Abul Fazal Enclave in New Friends Colony, Delhi, was married to one Muzammil in 2010 and had three daughters from the marriage. In 2015, her husband married another woman Shabana and threw her out of the matrimonial home with their three daughters. Local residents pressured the in-laws and she and her daughters were given shelter at the in-laws’ house.
A five-judge constitution bench of the SC had last year declared triple talaq as unconstitutional by three to two majority. Soon, many petitions were filed by Muslim women and NGOs challenging the constitutional validity of polygamy and nikah halala, a practice in which a Muslim woman can remarry her divorced husband only if she marries another man and consummates the marriage before separating.
Shabnam alleged that her husband was forcing her to go through nikah halala with his brother before accepting her back as wife. The SC in March had sought response from the Centre on a bunch of petitions challenging polygamy and nikah halala.
