NEW DELHI: Of the 11 indicted in the Central Bureau of Investigation's chargesheet on the Commonwealth Games' Time, Scoring and Results (TSR) scam, three are feared to be "absconding".
The agency on Monday told Special CBI Judge Talwant Singh that all attempts to get the presence of three accused were made, but there has been "no success". CBI has named promoters of two construction companies — Anil Madan, P D Arya (Faridabad-based Gem International Firm) and A K Reddy (Hyderabad-based firm AKR Constructions) — as accused in the chargesheet.

All attempts to reach them failed as even the "family members have refused to tell their whereabouts".
Acting on the agency's plea, the court has now issued proclamation under Section 82 CrPC against the accused. Under Section 82 CrPC, if any court has reason to believe that a person against whom a warrant has been issued has absconded or is concealing himself than the court may publish a written proclamation requiring him to appear at a specific place and at a specified time not less than 30 days from the date of publishing such proclamation.
The judge ordered that the proclamation be issued in any two leading English and Hindi dailies in Delhi-NCR region for Anil Madan and P D Arya and in any two English and Telugu dailies in Hyderabad for A K Reddy.
According to CBI, AKR Constructions was given a sub-contract for TSR work by another sub-contractor, Gem International that itself was a sub-contractor for 'Swiss Timing'.
The court issued non-bailable warrant (NBW) against OC treasurer M Jeychandran after the CBI submitted that he is not co-operating in the investigation, and has stopped appearing before it after his role surfaced as an accused in the case. "I am satisfied that he (Jayachandran) has intentionally stopped appearing before the CBI despite notices to appear before the concerned Investigating Officer. It is a fit case where NBW be issued against him," the judge said.

The court also summoned the other accused, including sacked CWG Organizing Committee chief Suresh Kalmadi from Tihar Jail, on Tuesday after taking cognizance of the chargesheet.
Swiss firm Swiss Timing, which was given the contract and is named as the 11th accused in the case, has also been asked to appear before it through its official by July 14.
"Summons should be issued to its (Swiss Timing) CEO by diplomatic channels through Ministry of External Affairs and also by email, fax and international registry, returnable by July 14," the judge said.
