The Supreme Court has declined to vacate its order asking the Kerala High Court not to pronounce judgement on the appeal against the acquittal of all the accused in the Kozhikode ice-cream parlour sex scandal.
NEW DELHI: The Supreme Court on Wednesday declined to vacate its order asking the Kerala High Court not to pronounce judgement on the appeal against the acquittal of all the accused in the Kozhikode ice-cream parlour sex scandal. A Bench headed by Justice B N Agrawal refused the plea of the accused persons seeking to vacate the February 23 order in which it had asked the High Court to proceed with the hearing on the appeal.
However, it had said the High Court would not render the judgement. The order was passed on the petition filed by Anweshi Women's Counselling Centre President K Ajitha challenging the High Court order not allowing her time to appoint lawyer.
It was on the basis of the probe conducted by the organisation that the case was registered by the police on August 6, 1997. The trial court on January 12, 2006 had acquitted the 16 accused including the former Minister in the state and Muslim League leader P K Kunhalikutty. The organisation has challenged the acquittal of all the accused. The accused had contended that it was a tactics to delay the proceedings before the High Court. Besides Kunhalikutty, who faced the trial were C Sreedevi, P P Abdullah, Edakkattui Khaderkutty, P A Abdulrehiman, M K Abdul Khader, Kalarikkal Basheer, James Joseph alias Joemon, K T Joseph alias Ouseppachan, Baby Joseph alias Queens Baby, Cheriyarampath Mohammedkutty, T P Dasan, O Rajagopal, A Arvindakshan, Baijunath Karippaly, P K Rafi and N Vijayan.
