The SC also censured West Bengal government over the delay in the release of Sharma, who was arrested for sharing a

meme

of West Bengal chief minister Mamata Banerjee.

The apex court had ordered her release on Tuesday and asked her to tender an apology.

The top court's decision came after the BJP leader's lawyer informed it that Sharma was not released yesterday and before her release today she was asked to sign an apology letter prepared by the police which said she will not post the meme again.

Earlier, Sharma's lawyer had told the SC that the police had not released the BJP leader to which the apex court had said that it will issue a notice of contempt against the West Bengal government.

The court had yesterday granted bail to Sharma, against whom a complaint was filed in Bengal for sharing a photo in which Banerjee's face was photoshopped onto actor Priyanka Chopra's picture from a MET Gala event in New York.

It had observed that freedom of speech ends when it infringes upon the rights of others.

West Bengal police arrested Sharma on May 10 under section 500 (defamation) of the IPC and under other provisions of the Information Technology Act on the complaint of local Trinamool Congress leader Vibhas Hazra.
