SC on same-sex marriage: Fine words but flawed logic

An analysis critiquing SC verdict on same-sex marriage argues recognition of marriage is well within court’s ambit & court diluted its own privacy judgment

In refusing to recognise the LGBTQI+ community’s right to marry, the Supreme Court diluted the right to privacy, which it itself had elevated to the pedestal of a fundamental right under Article 21.

SC refused to take to its logical end the idea behind decriminalising same-sex relationships, negated the fundamental right to live with dignity irrespective of one’s sexual orientation, and granted more latitude to the state than it needs, to defeat the claims of the community for legal recognition to their marriages and enjoy the rights that flow from the relationship of marriage.
