NEW DELHI: The Supreme Court on Friday issued notice to Andhra Pradesh chief minister Y S Jagan Mohan Reddy on a plea seeking cancellation of bail granted to him in a disproportionate assets case.

A bench of Justices Abhay S Oka and Pankaj Mithal also issued notice to CBI and sought response of the agency as well as from Reddy on an appeal filed by YSR Congress rebel MP Raghu Ramkrishna Raju, who claimed in his petition that he approached the court as his “conscience is shaken by the manner in which the state machinery is being manipulated to suit the sitting chief minister of the state”.



Advocate Balaji Srinivasan, appearing for the petitioner, contended that the Telangana high court erred by rejecting his plea for cancellation of Reddy’s bail as the order was passed mechanically without appreciating that the accused had breached his bail condition. He also challenged the order granting exemption to Reddy from personal appearance in the trial. “The impugned orders has caused a travesty of justice in as much as it has permitted the accused and prosecuting agency to have a ‘friendly match’ while the umpire (the HC) has lost its wicket,” the petition said.



“In the present case as well, there appears to be a friendly match being played between the accused and prosecution, which has shown no sense of urgency or intent towards completing prosecution of the criminal trials. ...The criminal trial in the present case is artificially being directed towards acquittals/discharge of the accused persons by simply delaying and prolonging the trial. The prosecution has been supporting the accused persons’ endeavour in this regard,” the petition said.

“The so-called changed circumstance of the respondent no.1 becoming the CM should not have had any bearing on the grant of permanent exemption; and simply sends out the message that persons in power get liberties which an ordinary person would not,” it said.

Even for hearing the said case with several dates it comes to light for public awareness, showing that how judiciary is working or facilitating for the Accused and Respondents against the victims and Petitioners who may not see the hope of finding judgment in their life time. Now it is the time to add the right to justice also in the Right to life as fundamental right with a specific period and if failed by investigation agencies and judiciary to complete it, the victims and petitioners must be paid heavy compensation from the public exchequer by allotting the funds under judiciary in annual budget and also it be recorded in the annual reports of performance by all responsible in investigation agencies as well as judiciary officers for their promotional avenues and for demotions and removal from services etc. Now a days that judiciary is coming out about their functioning in tandem with legislature and but the burden of bad name is carrying by executive. The Constitution has so many provisions to safeguard the judicial officers and the politicians also even they involved in alleged criminal cases would get liberal bails and without bar such elements to contest elections and become MLAs, MPs, Ministers, Chief Ministers and even in future become PM also putting the lives of 1.5 Billion people and vast land of this country also. It has been proved that 4000 plus alleged criminal cases on them the elected members in various courts even the then CJI NV Ramana gave an ultimatum to complete those pending cases even in decades by one year in all courts in 2019 but that one year never comes before judiciary to complete even hopefully in 2029 also. So, that is the strength of legislature and judiciary in our country with the safeguards given by the constitution of our country. Mera Bharat Mahaan. Jai Hind.
