Maharashtra CM Uddhav submits resignation to governor after SC refuses to stay floor test

Maharashtra chief minister Uddhav Thackeray on Wednesday resigned ahead of floor test tomorrow. The Supreme Court rejected Uddhav government's plea and refused to stay the floor test in the Maharashtra assembly tomorrow. A vacation bench of Justices Surya Kant and J B Pardiwala heard arguments on behalf of Shiv Sena, its rebel MLAs led by Eknath Shinde, and the Governor on the plea in the hearing conducted after 5 pm through hybrid mode. Justice Kant: Assuming a floor test takes place, who are competent to participate?
Tomorrow if these people are disqualified, then the pool changes.. the Supreme Court has clarified that there is no connection with the floor test, says Kaul
18:34 (IST) Jun 29
Supreme Court in its judgment had said disqualification proceedings have no bearing on Floor Test, Kaul said
Supreme Court says the moment a CM shows reluctance, it prima facie gives the view that he has lost the confidence of the House.

17:49 (IST) Jun 29

The people who have changed sides and defected cannot represent the will of the people. Can't the Governor trust the Court to not call a floor test tomorrow? Will heavens fall if there is no floor test tomorrow?

Singhvi

17:47 (IST) Jun 29
May I completely answer with a hypothetical question. Suppose in a case, people have simply defected. They walked to the otherside, and the governor asked for a floor test. Will this not blow away the tenth schedule to smithereens, Singhvi said.
17:46 (IST) Jun 29
Suppose a govt knows that they have lost the majority of the house, and the speaker is asked to issue disqualification to those withdrawing support. Then at that point should the Governor wait for calling a floor test or can he independently decide under Article 174, asks Justice Kant:
17:40 (IST) Jun 29

We are not rebels. We are Shiv Sena. We are carrying forward the agenda and ideology of Balasaheb Thackeray's Shiv Sena. We will work for the Hindutva ideology and development of the state

We will reach Mumbai tomorrow and participate in the Trust Vote. After that, a meeting of the Legislative Party will be held, following this the further course of action will be decided

Eknath Shinde, at Guwahati airport

That apart, another contention is on the undue haste shown in the matter. The Governor is bound to act on the aid and advise of the Council of ministers. Here he may act on the advise of ministers or not, but definitely cannot act on the advice of opposition, says Singhvi
17:36 (IST) Jun 29
If these MLAs are allowed to vote tomorrow, then milordships would be permitting voting by MLAs who may be disqualified later. That goes to the root to the democratic principles, says Singhvi
