CHANDIGARH: Punjab and Haryana HC Wednesday quashed criminal proceedings against 2004-batch Haryana Civil Service (HCS) officers in a case registered by the state anti-corruption bureau (ACB) over alleged irregularities in their selection, reports Ajay Sura.

Justice N S Shekhawat passed the order while allowing a petition filed by Jaiveer Yadav and other HCS officers, who had sought a direction to quash the FIR registered against them in Oct 2005 under sections of IPC and Prevention of Corruption Act. ACB had filed a chargesheet before Hisar district court on July 5, 2023, against 27 persons, alleging irregularities and malpractices by the commission in selection of the 2004-batch HCS officers.

The petitioners submitted before HC that they had already been given clearance, and thereafter even appointed to various positions in 2016, and could not be tried for the same offence again.

Justice Shekhawat was informed that the petitioners had filed a case before the HC in 2012, in which a division bench held that candidates who were non-tainted should be considered as fresh candidates against the existing vacancies, and offered appointments.

The matter was examined by senior govt officials, who did not find any irregularity in the selection of petitioners. It was thereafter referred to the state vigilance bureau, which gave a clean chit to 38 candidates, HC was informed.
