A division bench comprising Justice Sureshwar Thakur and Justice Sudeepti Sharma passed these orders recently while allowing a plea filed by a former Indian Army gunner from Punjab's Hoshiarpur. The petitioner, who had moved HC in 2020, died on May 14, 2021, during the pendency of the case, which was represented by his legal heirs after his death. The soldier was enrolled in the Indian Army on July 30, 1971, in a fit state of health and was invalided out of service from March 3, 1979 after he became neurotic.

The HC also issued directions to the military authorities to release the soldier's benefits within three months. All the benefits will be paid to his legal heirs.
