HC warns officials from UP over illegal private land use

Allahabad HC has warned UP authorities against using land of private citizens without acquiring them through proper legal procedures, warning of heavy penalties and recoveries from personal accounts of officials who flout the directive.

A bench of Justices Manoj Kumar Gupta and Anish Kumar Gupta made the observation while ordering compensation for a Bareilly woman whose land PWD acquired for a road-widening project without paying her.

In its March 4 order, the bench directed District Level Committee to determine the compensation and pay the woman, Kanyawati, within four weeks along with interest. HC held that the right to property being a constitutional right, instead of a fundamental right, was on a par with human rights and a person could not be deprived of it.
