Two lawyers parse Rajasthan’s Right to Health bill and argue that the state must define ‘emergency’ and create a reimbursement fund

In August 2020, as the nation grappled with the first wave of the pandemic, the Supreme Court handed down a significant verdict in Sachin Jain vs Union of India. It reprimanded states for not having enacted adequate laws on public health, and directed all states to draw up legislative and executive master plans. In its judgment, the court drew attention to the principle that every individual should have the right to emergency treatment and critical care at both public and private hospitals, irrespective of their ability to pay the fees.
