34 yrs on, HC disposes of appeal filed by Dhankhar, the lawyer
JAIPUR: The Rajasthan high court disposed on Monday of an appeal in a case of culpable homicide filed 34 years ago through Jagdeep Dhankhar, then a lawyer practising in the Rajasthan HC and now vice-president of India.
The HC reduced the punishment awarded to the accused to the jail term he had already undergone. However, the court said that if the accused did not deposit the fine imposed in the case within two months, he would have to face "default" punishment, which is the original punishment.
The ADJ court had sentenced the appellant to four years' imprisonment and a fine of Rs 1,000 for culpable homicide. An appeal was then filed in the HC against this order and the HC had suspended his sentence after he spent two months in jail. He was currently out on bail.
On Monday, Justice Mahendra Goyal disposed of the appeal of Gurudayal Singh, filed in 1989 through Dhankhar.
The appellant's counsel Bhavna Choudhary told the court that on March 6, 1988 a report was registered at Kishangarh Bass police station, in Alwar, that Rajendra Singh had been stabbed and injured. As Singh succumbed to injuries during investigation, the court tried the accused for murder.
On behalf of the appellant it was said that the incident was 35 years old and the appellant was now 83. In such a situation, his punishment should be reduced to that already served, the counsel argued. The single bench upheld the appeal and disposed of the matter.
