On Tuesday, the Delhi High Court refused to pass an injunction order against the film Nyay: The Justice, based on late actor Sushant Singh Rajput’s life. SSR’s father KK Singh had approached the HC in 2021 to stop the film but his plea was rejected, after which he approached the court again, claiming that the film violated SSR’s personality rights. The court said on Tuesday, “The rights ventilated in the plaint – i. e. , the right to privacy, the right to publicity and the personality rights, are not heritable. They died with the death of SSR. ”

‘DELHI HC’S OBSERVATIONS WILL BE APPLICABLE FOR OTHER FILMS AS WELL’ Sushant’s father’s application also mentioned that he is “seeking an interlocutory injunction against the defendants using SSR’s name, caricature, lifestyle or likeness in any films or other ventures. ”
Vivek Narayan Sharma, a senior Supreme Court lawyer, explains, “The remedy of injunction is very specific, hence it is only for this film. SSR’s family may approach the court against other films too in future; however, Delhi HC’s observations regarding the right to privacy will remain true even in that case. So, hypothetically, it will be applicable for other films too. ” He adds, “In the Puttaswamy case (2017) as well, the Constitution Bench of Supreme Court has crystalised the issue at hand that right to privacy remains till the person is alive and is not inheritable. ”
