A teacher in Ohio is suing the Lakota Local School District after she was fired for allegedly calling in sick to attend a concert in Nashville. Eileen Washburn, who was an English teacher at Lakota West High School, claims her termination was wrongful. According to a report by the WSMV4, Washburn was accused of falsifying sick leave on February 8 and 9, 2023, when she allegedly attended a concert, telling colleagues about her plans.

The Allegations
The school district asserts that Washburn failed to provide a valid explanation for her absence and refused to discuss her sick leave in detail. Washburn was placed on unpaid leave while the district investigated the matter, and in October 2023, she was officially fired.

The Teacher’s Defence
Washburn’s legal team argues that she had a medically approved reason for taking sick leave. She provided a doctor’s note indicating that the side effects from resuming a medication required her to miss work. Her lawyers contend that this was not an abuse of sick leave.

Alleged Discrimination
The lawsuit also claims that Washburn was treated unfairly compared to other district employees who were not disciplined or faced lesser punishment for similar situations involving sick days.

Washburn Seeks Reinstatement
In the lawsuit, Washburn is requesting her reinstatement, back pay, and full restoration of her seniority. In response, the Lakota Local School District has denied the allegations, stating that “the record speaks for itself.”
