MUMBAI: Baban Jadhav, the police constable who was recently dismissed for allegedly "instigating indiscipline against senior ranks" said that he would approach the Bombay high court to seek damages and reinstatement into the force.
Mr Jadhav said he had been left no other option because his complaints to various authorities, including the chief minister, were not being heeded.
M.N. Singh, who was police commissioner at the time, dismissed Mr Jadhav on November 29 for "airing vague and imaginary allegations in violation of service rules".
Mr Singh in his dismissal order said Mr Jadhav had resorted to an agitational path by wearing a black ribbon while on duty at the Kurla court on November 28 "despite being advised by his senior inspector not to do so".
Mr Singh invoked powers under Article 311 of the constitution and dismissed Mr Jadhav with immediate effect. He said an inquiry against Mr Jadhav would only "lead to further insubordination in the force".
Mr Jadhav denied the charge. He claimed Mr Singh had dismissed him without issuing him a single memo simply because Mr Jadhav had complained to chief minister Vilasrao Deshmukh and the chief vigilance commissioner about the alleged corruption surrounding the transfers of constables in 2000 and 2001.
Soon after Mr Singh took charge in May 2000, a large number of constables were transferred from police stations to non-executive postings. Within days, many of them were transferred back to police stations. However, the transfers were cancelled after Mr Jadhav complained to the CM.
In 2001, about 600 constables from various police stations were transferred to non-executive postings. These transfer orders, too, were altered to post many of them back to police stations.
Citing the renewed orders issued in December 2001, Mr Jadhav said scores of constables were transferred to sought-after police stations in Mulund, Santa Cruz, Saki Naka, Chembur, Kurla, Goregaon, and MIDC, among other places.
These constables had first been transferred to non-executive postings in the local arms division, Mantralaya and airport security, protection duty, the special branch or the Yellow Gate police station, he said.
He claimed he had a clean service record from the time he had joined the force in Thane in 1970. He had been dismissed along with many others for trying to form a police union in 1982.
