VIJAYAWADA: The
Andhra Pradesh high court on Thursday directed the Crime Investigation Department (CID) to submit the case diary pertaining to the crime registered against former minister Chintakayala Ayyanna Patrudu and his sons, Vijay and Rajesh.
They moved the high court with a lunch motion petition for urgent hearing and sought directions to quash the case against them.
They have also pleaded for bail as interim relief. The high court observed that the arrest of the accused should be with cogent reasons and said that it will examine the case diary before deciding the petition.
Ayyanna Patrudu and his younger son Rajesh were arrested in the wee hours of Thursday from their residence at Narsipatnam over alleged conspiracy to create forged No Objection Certificate (NOC) to construct their house.
The CID registered a case against them following a complaint lodged by one K Mallikharjuna Rao, executive engineer (EE), Polavaram irrigation circle, alleging that the NOC produced by Ayyanna Patrudu with his signature is fabricated.
Arguing on behalf of the petitioners, VV Satish said that the case was registered with malicious intent to wreak political vengeance. He said the petitioners obtained NOC in 2019 from the irrigation department and constructed the house according to the building plan given by local municipality.
Arguing on behalf of CID, additional advocate general P Sudhakar Reddy said the case was registered following a complaint from EE.
Considering the rival contentions, Justice R Raghunandan Rao asked the CID what was the purpose of the arrest when the inquiry has already been conducted. Even the provisions of CrPC to arrest the accused should be used with cogent reasons, he said. Directing the CID to submit the case diary to the court, Justice Raghunandan Rao posted the matter for further hearing on Friday.
