In a setback to the Baroda Cricket Association (BCA), the Gujarat High Court has passed an order that Vadodara civil court has jurisdiction to hear the suit filed by former Band BCA secretary Sanjay Patel.

VADODARA: In a setback to the Baroda Cricket Association (BCA), the Gujarat High Court has passed an order that Vadodara civil court has jurisdiction to hear the suit filed by former Band BCA secretary Sanjay Patel.
Patel had approached the HC after the Vadodara civil court dismissed the suit he filed against his removal from BCA's managing committee and secretary's post in September last year.

The civil court had said that it doesn't have jurisdiction to pass any orders in his case.
Patel then approached the district court that asked the civil court to return the complaint to Patel for presenting before a proper court. On July 28, the HC passed an order wherein it set aside the orders of civil and district court. "BCA had argued that the civil court doesn't have jurisdiction but the HC accepted my contention that the civil court has jurisdiction to hear my suit. I will approach the civil court soon," Patel told TOI.
BCA had also contended that Patel would have to take permission of the charity commissioner before filing the civil suit and then approach the district court.
"My fight is against the dictatorship of the BCA managing committee and some office-bearers who removed me from the managing committee accusing me of flouting eligibility rules. There are many others in managing committee who are not eligible for being elected in that committee," Patel added.
BCA secretary, Anshuman Gaekwad said, "BCA's legal committee will discuss the court order and take a decision soon. We will act on the basis of the committee's recommendations."

The BCA managing committee had removed Patel and four from the committee in April last year accusing them flouting eligibility criteria. Patel, who was also removed from the BCA secretary's post, had argued that he was an elected member and that the managing committee didn't have powers to remove him from the committee and the post. Patel's membership was also cancelled by the BCA in April this year on charges of financial irregularities in refurbishment project of Motibaug cricket ground dressing room.
