Sanjauli mosque row: Court dismisses local residents’ petition to become a party in case
Shimla: The Shimla additional district judge’s court on Thursday dismissed the application moved by the local residents of Sanjauli to become a party in the appeal filed by the All Himachal Muslim Organisation(AHMO). The appeal challenges municipal commissioner court’s Oct 5 order to demolish the top three unauthorised storeys of Sanjauli mosque within two months.Appellant organisation’s advocate Vishwa Bhushan told the mediapersons that the court, while dismissing local residents’ application, said they do not have any locus to approach the court in this case. He added that on appellant’s request, the court has now posted the hearing of the case for Nov 18 to decide the maintainability of the appeal. Despite Sanjauli mosque committee’s undertaking to demolish the unauthorised portion of the disputed mosque, the AHMO had challenged Shimla municipal commissioner court’s Oct 5 order to demolish the top three floors of the five-storey disputed mosque before the additional district judge’s court. The AHMO had submitted that the mosque committee head had no authority to give an undertaking and the mosque had been constructed on the Wakf Board’s land. Therefore, the municipal commissioner court’s order, based on the undertaking given by the Sanjauli mosque committee, is contrary to the facts, the AHMO had submitted.
