CBI biased against Mishra, NCP tells governor

PATNA: A Nationalist Congress Party (NCP) delegation led by the party's state president Nawal Kishore Shahi handed over a memorandum to governor Vinod Pande on Thursday, accusing the CBI of being biased in seeking prosecution of former chief minister and NCP leader Jagannath Mishra for the fourth time "on the basis of the same evidences and charges".

requesting the governor to reject the cbi plea, the delegation said that fresh chargesheets on the basis of the same charges would be a violation of article 20 of the constitution, which forbids punishment of persons more than once for the same charge. the memorandum pointed out that the law did not allow prosecution of a public servant without the sanction of the competent authority to enable the public servant to execute his duty fearlessly. it insisted that before granting sanction to the cbi the governor should consider if there was any new evidence produced by the investing agency against mishra. there are already four ongoing cases based on the same evidences, it said, adding "what will be the use of another case on the basis of the same charges?" the memorandum recalled that the cbi had erred in naming mishra in the chargesheet as the chief minister in 1988. the delegation insisted that repeated cases against mishra put a question mark on the impartiality of the premier investigating agency. it also accused the cbi of violating article 14 of the constitution on equality before law. the cbi had a few days ago approached the governor seeking his sanction for prosecution of mishra, rjd president laloo yadav, and former bihar ministers c p verma and vidya sagar nishad in a fresh conspiracy angle case related to the fodder scam.
