PATNA: A division bench of Justice Shiva Kirti Singh and Justice Shivaji Pandey on Monday transferred the hearing on a writ petition against the Bihar Industrial Area Development Authority (BIADA) to another bench. The petition has challenged the allotment of industrial plots for developing an educational institution and an industry to the wards of two state ministers.
The court directed that this case be transferred to any other bench of which Justice Shivaji Pandey is not a member.
Earlier, a division bench comprising Justice S K Katriar and Justice A Amanullah had transferred hearing on this case to any other bench in which Justice Amanullah was not a member.
The writ petition, filed as a PIL by Lok Samata Party president P K Sinha and social activist Sarwar Ali Warsi, submitted BIADA did not issue a gazette notification to invite objections to the development of these industrial plots in the Hajipur industrial area. According to petitioners' counsel Dinu Kumar, BIADA did not comply with a state industry department resolution of January 16, 2006 to give national advertisement for allotment of the industrial plots.

The Patna high court on Monday reserved judgment on the criminal appeal of Patna treasury office assistant Girish Kumar, challenging the order of a special court to attach his property, including a house worth Rs 48 lakh.
The special court ordered the attachment in a vigilance department case against Kumar, charging him with amassing property beyond his known sources of income.
PIL:
A division bench of Justice S K Katriar and Justice A Amanullah on Monday partly heard a PIL of Saryu Roy, seeking adequate supply of Sone river water to the Sone Command Area in Bihar for irrigation and drinking purposes.
The case will again be heard on Tuesday. On Monday, the NTPC challenged the maintainability of the PIL which contends that the Sone water could not be diverted for use by NTPC for power generation.
