NOIDA: The district consumer forum has issued a notice seeking punitive action against the Greater Noida Industrial Development Authority (GNIDA) CEO for not implementing an order issued by the national commission 9 years ago.

Earlier in June, the state commission stayed a one-month jail term for the CEO and remanded the case back to the district forum for further proceedings. The state commission found the earlier decision was passed without giving the official an opportunity to present his side of the story.

Based on the state commission's order, the district commission issued a notice to the GNIDA CEO on July 31 under Section 251 of the CrPC. The next hearing is scheduled for August 17.

The case centres around Delhi-based entrepreneur Mahesh Mitra, who has been embroiled in a legal battle within the consumer courts to secure an industrial plot in Greater Noida since 2005.

Mitra applied for an industrial plot under a 'first come, first serve' scheme in 2001 to set up an automobile shop, but GNIDA did not allot the land, citing various reasons. Mitra filed a case with the district commission in 2005.

In 2006, the district commission directed GNIDA to allot a plot ranging from 1,000 sqm to 2,500 sqm within two months. In May 2014, the national commission instructed GNIDA to allot a plot ranging from 500 sqm to 2,500 sqm, based on Mitra's requirements, within three months.

However, despite multiple attempts by the district forum to execute the order, GNIDA allegedly obstructed these efforts. Consequently, in January this year, the district forum issued the sentencing order, leading to the recent appeal and subsequent decision by the state commission.

On January 7, the district consumer forum sentenced the GNIDA CEO to 1 month in jail along with a fine of Rs 2,000 for not complying with the 2014 order of the national forum. However, the order did not specify any particular CEO.

Following the January 7 order, GNIDA filed an appeal with the state commission, which remanded the case back to the district forum due to the absence of an opportunity for the GNIDA to present its side of the story.
