The court granted the relief citing absence of demonstrated intent to create unrest or immediate threat to public order.

Bode, 45, was booked under IPC section 153-A(1)(b), a provision that deals with promoting enmity between different groups based on religion, race, language or place of birth.

The case was initiated following a complaint by Yavatmal anti-terrorist squad, which accused him of circulating an article supporting Naxalite ideology and calling for a revolution against govt.

According to the prosecution, Bode's article, translated loosely as 'Struggle against suppression of rights in India', included a slogan, 'Hail India, Hail Constitution, Hail Struggle', which authorities argued was a veiled call for an armed revolution.
