The tribunal has absolved Bajaj Alliance Insurance Company of responsibility, since the insurance policy did not cover accidental death of person travelling illegally in the Mahindra and Mahindra jeep.
Advocate NM Agrawal, counsel for the applicant, argued that the accident happened due to the mistake of the driver of Mahindra and Mahindra vehicle, which was not allowed to carry passenger. Vehicle was a pickup van. The insurance of the vehicle only covered transport of goods from one place to another.
The accident took place near Tembhurni diversion on Pune-Solapur road on July 8 night, in which Muzzamil Gulam Gouse (30) was killed on spot. His father Gulam Gouse (62) filed an application for compensation and demanded 7 lakh.
The father later filed a case for execution of recovery process for getting the award amount of 4.2 lakh.
On this application, the tribunal has issued a show cause notice to Mahindra and Mahindra. Advocate Vinod Lohiya argued for the company while HG Jain appeared for Bajaj Alliance.
