Amravati Univ rejects dismissal proposal against officiating principal
Amravati: The Management Council of Amravati University rejected the proposal to dismiss Vivek Deshmukh, former officiating principal of Babaji Date Arts and Commerce College, Yavatmal, after its inquiry committee found the charges levelled by the college management to be unsubstantiated and procedurally flawed.The council-appointed Dr Pravin Raghuwanshi committee stated that the college management, represented by Vinayak Date, failed to produce any concrete, documentary or testimonial evidence to support its allegations. The committee also held that the management's action violated the legal framework prescribed under Statute 53 and university rules, rendering the dismissal proceedings invalid.The controversy began when the college management moved a proposal to terminate Dr Deshmukh's services, citing multiple allegations ranging from impersonating a principal to financial misconduct. On the charge of "acting as a fake principal," the committee noted that Deshmukh was functioning under Order No. 26/2026, which granted him additional charge with approval from the competent university authority. It observed that the validity of such an administrative sanction can only be examined through a separate statutory process, and cannot be indirectly negated through a departmental inquiry. The committee stressed that actions backed by competent authorities during the relevant period cannot later be cited as grounds for disciplinary action, as this would violate administrative consistency.
The allegation that Deshmukh illegally regularised the posts of certain teachers without informing the management was also dismissed. The committee clarified that such regularisation falls under the official and unavoidable duties of a principal.
