Woman accused of poisoning hubby to death gets bail

Mumbai: A sessions court on Wednesday granted bail to Santacruz homemaker Kavita Shah (46), accused along with her lover Hitesh Jain, of poisoning her husband Kamalkant Shah to death in 2022. Shah was arrested on Dec 1, 2022. Seeking bail, her lawyer submitted that there is no evidence to show that she committed the offence. Shah also denied any involvement in the suspicious death of her mother-in-law.The detailed order copy is yet to be made available.In March, observing that she was reluctant to get her husband medically treated and was the only one in the family who avoided undergoing a blood test to ascertain the presence of heavy metal, the judge had said that there is substance in the contention of the prosecution that the death was caused due to a heavy percentage of a poisonous substance. The metal tests showed that the value of arsenic was 425.76 and thallium was 362.34, which was in excess of normal amounts. The judge also said that there was evidence in the form of CCTV footage to show that the accused were engaged in an affair and used to stay in hotels.Opposing the bail plea, the prosecution had submitted that the murder was pre-planned. It was further submitted that the same symptoms which were present before Kamalkant's death were also found in respect of his mother, Sarladevi Shah. The prosecution also submitted that the relationship between Shah and Kamalkant was not cordial. In May 2022, after being separated, she again came to live in the house of her husband, but the relationship continued to be strained. Initially, she was cooking food for herself and her daughter. The prosecution alleged that she suddenly started to cook food for all family members. She started serving the food to Kamalkant. When she was in the kitchen, she diverted the servants to other work. While Sarladevi died on Aug 13, 2022, her son died soon after.
