Two sentenced to five years imprisonment for robbing jewellery worth Rs 12 lakh

MUMBAI: Observing that such type of offences are increasing day by day and require deterrent punishment so that the present case can serve a precedent to deter such offenders, a sessions court convicted and sentenced two men to five years rigorous imprisonment for wrongfully restraining two employees of a gold factory, hitting them with sticks and robbing jewellery worth Rs 12.85 lakh in 2014. Finding the duo, Mubin Khan (38), private service, and Santosh Vichare, (43), a civil contractor, guilty, judge VM Sundale said, “The prosecution on the basis of above cogent, trustworthy and reliable oral evidence and recovery of robbed gold jewellery proved that accused no 2 and 5 and other two absconded accused in furtherance of their common intention wrongfully restrained the informant Prajapati and Roshanali, caused hurt to them, robbed the gold jewellery wallets and mobiles belonging to them.”

A third accused, Fuzail Khan (40), a cloth seller, was sentenced to three years in jail for acquiring the stolen gold. Two others, Vidyut Sarkar (37), a gold smith, and Mohamed Khan (46), a driver, also part of the heist, are absconding.

In the 38 page judgement copy, the judge directed the Senior Police Inspector, Byculla Police Station to secure presence of the absconding accused and file a supplementary chargesheet against them.

The incident took place on August 16, 2014 at 4 pm, when the factory’s employees, Ruparam Prajapati and Roshanali Shaikh were on their way on a bike to deliver the jewellery, finger rings and ear rings weighing 462 grams, to Zaveri Bazaar. The accused came in a car and forced the duo into the vehicle before robbing and letting them go at Antop Hill.

Relying on their testimonies, the judge said, “It is to be noted here that Ruparam in his evidence categorically deposed entire incident. He correctly identified accused… at the time of conducting test identification parade and before this court. He also identified robbed gold jewellery recovered from accused…His evidence stood true on the touch stone of cross-examination,” the judge said.
