Observing that his valuable right was jeopardised, Bombay high court has directed a special court to re-adjudicate an application by an accused, who was alleged to be an Indian Mujahideen member, challenging invocation of charges under the Maharashtra Control of Organised Crime Act.

Mumbai: Observing that his valuable right was jeopardised, Bombay high court has directed a special court to re-adjudicate an application by an accused, who was alleged to be an Indian Mujahideen member, challenging invocation of charges under the Maharashtra Control of Organised Crime Act.The direction by Justices Sadhana Jadhav and Milind Jadhav on Wednesday came on an appeal by Mubin Shaikh against the special court’s April 24, 2019 order rejecting his application challenging invocation of MCOCA.Shaikh and several others were arrested by Mumbai police in 2008-09 for allegedly being members of IM’s media cell. Prosecution said emails were sent by some co-accused to media organisations in August 2008 claiming responsibility for the Ahmedabad blast that killed over 50 persons and injured several others. —Rosy Sequeira
