MUMBAI: Three persons, including film director Kaizad Gustad, were arrested by the railway police on Wednesday in connection with the accidental death of assistant director Nadia Khan on May 25.

MUMBAI: Three persons, including film director Kaizad Gustad, were arrested by the railway police on Wednesday in connection with the accidental death of assistant director Nadia Khan on May 25.
Ashish Udeshi, another assistant director allegedly involved in the cover-up, and a railway policewoman were also arrested.
Gustad and Udeshi were booked for “causing death due to negligence’’ (Section 304-A) and for registering a false FIR.

However, when they were produced before additional chief metropolitan magistrate Usha Iyer, she pulled up the police for not applying Section 304 of the Indian Penal Code which is for “culpable homicide not amounting tomurder’’.
The two have been remanded to police custody until June 10.
Iyer contended that both Gustad and Udeshi were aware that shooting on the tracks was risky and that Nadia could get knocked down by a train. These facts and circumstances should attract Section 304 of the IPC, she said. Constable Darshana Vaity, who was arrested and released on bail, was alleged to have known about the accident but had hidden the truth from her seniors.

Vaity, who was posted at Mahalaxmi station on May 25, had visited the accident spot and accompanied the victim to Nair Hospital. However, she did not report the accident. She has been released on a bail of Rs 6,000.
Assistant commissioner Ramesh Pargunde said that Gustad had permission to shoot on platform No 1 and track no 1 (which is not used) but that he was shooting on track no 4 instead, where Nadia was killed.
Meanwhile, deputy police commissioner Ashok Dongre has begun his inquiry into the preparation of a fake panchanama by the Worli police.
Dongre, who had summoned officers from the Worli police in this connection, said he would not comment unless the inquiries were over. The officer who made the panchanama was identified as sub inspector Advatkar.
