Court acquits woman for human trafficking

Thane: The Thane Sessions Court acquitted a 41-year-old woman of all charges related to human trafficking and running a flesh trade operation.
The Additional Sessions Judge, Amit M. Shete, who presided over the trial, delivered a detailed judgment that highlighted significant lapses in the prosecution's case.
The case, registered in 2019 by the Rabodi Police Station, involved serious allegations of trafficking and exploiting women for prostitution. Based on information that the accused woman was indulging in the flesh trade, the then senior inspector Ashok Kadlag, along with his team, conducted a raid on December 9, 2019. A decoy was sent, and the trap was laid near a hotel under the jurisdiction of the Rabodi police station. The accused was tried in the case, and accordingly, a trial was conducted.
After hearing both sides, the judge observed that the prosecution failed to present convincing evidence to substantiate the charges under Sections 370(2) and (3) of the Indian Penal Code and Sections 4 and 5 of the Immoral Traffic (Prevention) Act under which the accused was booked then by the police.
One of the critical observations made by the judge was the unreliable nature of the witnesses. The alleged victims, who were expected to support the prosecution's claims, instead testified that they knew the accused and denied any involvement in illegal activities. The judge noted that the testimonies of these witnesses did not align with the prosecution's narrative, casting doubt on the credibility of the accusations.
Furthermore, Judge Shete pointed out that the prosecution failed to produce direct evidence of coercion or exploitation. The police officers involved in the operation admitted under cross-examination that they did not witness any obscene activities or transactions indicative of prostitution at the hotel where the raid took place.
Accordingly, the judge then noted that the prosecution has miserably failed to prove the charges in the court and hence the accused is to be acquitted of all the charges.
