MUMBAI: Over a decade after a witness in a criminal case was allegedly kidnapped from outside the sessions court premises at Kala Ghoda and threatened not to depose, a sessions court acquitted the accused after the witness failed to identify him.

“There is no evidence to establish that informant was wrongfully confined by the accused. Evidence regarding threatening is of general nature. There is no evidence to establish that there was prior meeting or prior concerned between the present accused or co-accused for committing the alleged offence,” the court said.

Acquitting Firoz Khan alias Tubelight, the court said prosecution failed to establish guilt of accused beyond reasonable doubt. “The evidence is not sufficient to hold accused guilty for alleged offence. The prosecution did not lead corroborative evidence to substantiate allegations,” the court said. The alleged incident took place in 2012, when victim Parvez Shaikh was at court.
