MUMBAI: The Bombay high court granted interim relief to veteran singer
Kumar Sanu in a defamation suit filed against his former wife Rita Bhattacharya and others. HC observed certain interviews given by Rita prima facie appeared to contain a personal tirade causing reputational harm to the plaintiff. HC restrained her from making further contentious statements or giving interviews until the interim application is decided.
HC also kept open the possibility of mediation between the parties and directed the defendants to file their replies which will be heard on Jan 28. Justice Milind Jadhav passed the order while hearing an interim application filed by Kumar.
Kumar, represented by advocate Sana Raees Khan, alleged Rita had made objectionable and defamatory statements against him, causing reputational harm, mental agony and financial losses, including the cancellation of pre-scheduled international shows. The suit also names digital platforms as defendants. HC noted although the two were married for a long time, they have been legally separated for over 32 years, a crucial factor while assessing the grievance.
Justice Jadhav made it clear no further reputational damage should be caused to the plaintiff during pendency of the proceedings.
During the hearing, counsel for Rita suggested referring the matter to mediation, citing recent familial developments, including the marriage of their son. HC asked the plaintiff to take instructions on whether he was agreeable to mediation without prejudice to his rights. The issue of mediation will be considered on Jan 28.
