Badlapur Encounter Case Live: Bombay High Court questions ability of police to overpower the accused

Advocate Amit Katarnaware said that the Bombay high coourt asked several questions, highlighting the absence of evidence. The court highlighted that it appears from the record that Akshay Shinde, accused in Badlapur sexual assault case, was shot dead on a point-blank range. The court asked whether the CCTV footage Taloja Prison till the hospital have been preserved or not. If not preserved, it is required to be preserved.

"Thirdly, if the FIR is registered against Akshay Shinde for attempt to murder, why the deceased's father's complaint is not registered and treated as an FIR. On that aspect, the State has submitted before the court that it will take instructions and they had registered an ADR in that aspect and that the CID has not been handed over the case papers by the local police. On this, the court expressed its disappointment as to why the papers were not handed over when the case has been handed over to the CID..." says advocate Amit Katarnaware.

In the ongoing Badlapur encounter case, after directed for all case papers to be immediately handed over to the state CID, Bombay High Court asked the police that why the files had not been handled to CID, which will be conducting a probe into Shinde's death, yet.

The Court said while it was not raising any suspicion at this stage, it was very hard to believe that Akshay Shinde managed to seize a pistol from a police officer and open fire.
