All the accused were charged with rioting and murder on January 9, 1993, at Kalapani Junction, BIT Chawl and Sakli Street.
In her deposition before the Sri Krishna Commission, witness Mumtaz Rehman had testified that the accused had attacked chawl number 12 in BIT Chawl, where 63 of 80 chawls were occupied by Muslims.
Rehman had also said the rioters stood with the police as they tried to enter the chawls and threw bottles from outside.
But when the mob tried to set fire to the chawls with gas cylinders, the police restrained them from doing so. Another woman, Mehrunissa Ansari, had given similar testimony to the commission.
Nagaonkar was arrested in 2001 after Rehman had named him as an accused. When the matter came up in court all the independent witnesses turned hostile and the prosecution had to rely on police witnesses.
The case fell through when the police could not show any seizure of weapons or even identify the accused in court.
Twenty seven men were named as accused in the FIR, of which seven jumped bail and are currently absconding while six are dead.
