38-year-old man sentenced to life in prison for raping mother in UP's Bulandshahr

MEERUT: A fast-track court in Bulandshahr sentenced a 38-year-old man to life imprisonment for raping his mother in a farm when she went out to collect fodder on Jan 16, 2023. While pronouncing the sentence on Monday, the court of additional district judge-II, Varun Mohit Nigam, took note of the mother's testimony against her own son and termed the case "rarest of the rare and a very serious matter which reflects poorly on the society".

The court said "if the victim of rape states on oath that she was forcibly subjected to sexual intercourse, her statement will normally be accepted, even if it is uncorroborated".

It added: "In this case, even the opinion of a doctor that there was no evidence of any sexual intercourse or rape may not be sufficient to disbelieve the accusation of rape."

The court also imposed a fine of Rs 51,000 on the convict.

Additional district govt counsel (ADGC), Vijay Sharma, told TOI: "The woman, 60, lived with her two sons at a village in Bulandshahr after her husband's death 10 years ago. She was accompanied by the elder son to the farm, when he raped her. The shocked woman narrated her ordeal to her younger son, who lodged a complaint on Jan 22, 2023."

An FIR was registered under IPC sections 376 (rape) and 506 (criminal intimidation), and the man, who is "mentally stable", was arrested.

The ADGC said, "After sexually assaulting his mother, the culprit threatened to kill her if she told anyone about the matter. He also demanded to have a physical relationship with her... The woman testified before the court and said the crime by her own son would haunt her for the rest of her life."
