Caste killing: Accused cop moves HC seeking police reports
Madurai: Suspended sub-inspector of police (SI) K Saravanan, father of Surjith, the main accused in the caste killing of techie C Kavin Selva Ganesh, moved the Madras high court on Tuesday, seeking a direction to the trial court to furnish copies of the police reports and other documents under Section 230 of BNSS, 2023, to him.Justice L Victoria Gowri ordered notice to the CB-CID on the petition filed by Saravanan, who sought a direction to the II additional district court (PCR), Tirunelveli.
In his petition, Saravanan stated that the non-supply of mandatory documents, despite his consistent appearance before the trial court and filing copy applications, impaired his right to effectively prepare his defence and infringed the guarantee of a fair trial under Article 21 of the Constitution.He stated that the right of an accused to receive the documents and statements submitted before the court is absolute and must be adhered to by the prosecution and the court. A fair trial and due process of law include the requirement of fairness, which is jeopardised when an accused is not provided with the materials necessary to understand the allegations against them.He further stated that the continuation of proceedings without supplying the mandatory copies constituted an abuse of the process of the court and caused serious prejudice to him. Hence, the petitioner moved court.The case of the prosecution is that Ganesh, a scheduled caste man from Tuticorin district, was working as an IT employee in Chennai. He was in a relationship with S Subhashini, belonging to the maravar community, a resident of Palayamkottai in Tirunelveli district.On July 27, 2025, Subhashini's brother, Surjith, murdered Ganesh at KTC Nagar. Police arrested Surjith, his father, Saravanan, and cousin, Jayapal. Surjith's mother, Krishnakumari, an SI and an accused in the case, was placed under suspension. The probe in the case was subsequently transferred to the CB-CID.
