Ludhiana: The District Consumer Disputes Redressal Commission has ordered a Delhi-based company to pay a composite cost of Rs 10,000 to a customer for not getting a mechanical defect of a massage chair rectified. The commission, comprising its president Sanjeev Batra and members Jaswinder Singh and Monika Bhagat, also ordered Messrs Roma International private Limited Delhi to refund Rs 2.8 lakhs, the price of massage chair, to the complainant, Trannum Fatma of Bhaura Colony-B, Jalandhar bye-pass Chowk, Ludhiana, along with interest at the rate of 6% per annum from the date of purchase of the chair, i.e September 8, 2016, till actual payment.
The complainant in her complaint to commission on January 1, 2020, said that she purchased massage chair in an exhibition organised by the opposite party company at a mall on the assurance of a salesman of that company. The product was having one year service warranty with premium delivery and free setup functional installation. The retail invoice dated September 8, 2016, was issued after receipt of payment of Rs 2,80,000. However, the representative of the company failed to install the product as agreed upon. The complainant approached opposite party company telephonically but none came to install the chair and it remained uninstalled and non-functional. The complainant not only suffered a loss of Rs 2,80,000 but also suffered mental agony and harassment at the hands of opposite party. The complainant then issued a
legal notice on August 6, 2018.
