allahabad: after a propracted legal battle, up state roadways transport corporation (upsrtc) won a case involving a prime property of 2,415 acres, located behind civil lines bus station here. allahabad high court dismissed the petition filed by one s s khursheed ahmad hasmi, who staked a claim to the property worth tens of crores. a supreme court three judge bench also upheld the high court judgement.
the disputed property comprised nazul land at 13, civil lines here. earlier, nawab a majid owned the property on the basis of a patta, granted for 50 years. just before his death, the nawab handed three-quarters of the property to the waqf board. later, his spouse zubaida begum had filed a case at the collectorate here, as the aggrieved party. the collector dismissed the begum's case and directed that it should be handed over to the upsrtc. before the property could be transferred, khursheed a hasmi filed a representation at the collectorate on november 20, 1998, but it was rejected. subsequently, on december 3, the district magistrate directed the mukhya nagar adhikari (mna) to get the land vacated. the landlord then filed a petition at the high court, under article 226 of the constitution, challenging the validity of dm's order on various grounds. on december 16, 1999 the court upheld the dm's judgement of december 3, 1998 as valid. hashmi filed a special leave petition 4329 / 2000 at the supreme court against the high court judgement. finally on september 7, the apex court which had granted stay on the judgement, ruled in favour of the state government. upsrtc legal officers said that the supreme court was received on september 13. save the mosque, mazar and madarsa, on the disputed land, the property will be transferred to the upsrtc.
