LUCKNOW: The Lucknow Bench of Allahabad High Court on Friday fixed May 14 as the next date for hearing the bail application of Madhumani Tripathi, wife of former state minister Amarmani Tripathi. Madhumani is prime accused in the Madhumita murder case.
Justice NK Mehrotra passed this order on the bail application moved on behalf of Madhumani Tripathi through her counsel Nalini Jain.
Counsel for Central Bureau of Investigation (CBI) Bireshwar Nath opposed the bail and prayed for some time to seek instructions on the said bail application.
The court accordingly fixed May 14 for next hearing.
The CBI counsel observed that it would be pre-mature to consider the bail application as the ten days of notice period was not complete as yet.
According to rules the defence counsel should give a notice to the prosecuting agency ten days before moving the bail application. Madhumani is currently in jail in judicial custody.
Meanwhile, a division bench of the Allahabad high court, Lucknow bench, comprising Justice Vishnu Sahai and Justice GK Gupta while quashing the detention of one Anurag Shukla under the National Security Act (NSA) ordered that he be released forthwith unless wanted in any other case.
The high court held the continued detention of petitioner Shukla under NSA as bad for the law, due to inordinate delay in deciding the representation of the petition by the central government relating to detention order passed by district magistrate, Sitapur, on August 9, 2003 under NSA.
The continued detention was also bad as there was delay in communicating the rejection order to the petitioner.
The court made these observations on a habeus corpus petition filed by SK Singh, advocate alongwith Ram Pratap Singh, advocate, on behalf of the petitioner.
The petitioner''s counsel argued that the representation of the petitioner dated august 21, 2003 was received by the central government and was rejected on September 9, 2003 without explaining the cause of the delay in the disposal of the representation and also in communicating the rejection order.
