LUCKNOW: A division bench of high court comprising Justice Jagdish Bhalla and Justice MA Khan here on Thursday stayed the order of November 22 last of the vice-chancellor, UP Technical University (UPTU) Prof Durg Singh Chauhan, till further orders by which he had directed the principals/director technical colleges affiliated to the UPTU to mention this fact in the mark sheet of such students who had approached the high court against the UPTU/colleges etc and whose writ had been dismissed.
The bench passed the above orders on the PIL filed by one Santosh Raj. It was urged on behalf of the petitioner that such an order amounted to threatening the students. The bench called upon the counsel appearing on behalf of the UPTU to call the V-C DS Chauhan at 1 pm on Thursday. The V-C appeared in court in person and said that he had done no wrong as the court cases consume a lot of time as a result of which the time frame of the examination disturbed.
The bench while giving two weeks time to the respondents to file counter-affidavit and one week for rejoinder affidavit ordered the PIL to be listed immediately thereafter.
Earlier the bench also directed the petitioner’s counsel to implead the governor who is the chancellor of all state universities. The counsel impleaded the chancellor immediately. The governor chancellor was represented by senior advocate SC Misra, who said that such an order amounted to contempt of court and the Constitution.
The bench also directed the state counsel to inform the governor to take up the matter seriously, while staying the operation of the impugned order till further orders.
