(AMAI) has hailed the

high court verdict

that cancelled the government order, which gave registration to the traditional vaidyas to practice Ayurveda.


The verdict of the division bench said that “the government order issued providing registration to the unqualified practitioners of naturopathy and other alternative medicines are in conflict with the provisions of the Central Act 1970.”

The court also said the government order is against “the orders of the government of India and the guidelines specified and therefore unconstitutional and the same are liable to be quashed.”

The court said, “the first provison to Section 38 of

Travancore-Cochin

Medical Practitioners (TCMP) Act is declared as unconstitutional and therefore struck down.”

AMAI state general secretary Dr Sadath Dinakar R said the section gave power to the government to provide license to traditional vaidyas where unqualified hands are not available.

“This provision was given in 1953 to provide B class registration when there was shortage of qualified persons, but it was used to give permission to traditional vaidyas till 2009. From now onwards, those who practice without qualifications will be punished under Section 34 (2) of the National Commission of Indian Systems of Medicine,” he said.

Dr Sadath the punishment under this section is Rs 5 lakh fine or one-year imprisonment or both. “AMAI has been engaged in a legal battle since 2000 in the high court and the Supreme Court,” he said.

AMAI asked the government to act against the quacks who are posing a serious threat to the health care system in the state in the wake of the court order.
