SC returns La Marts board case to HC
Kolkata: According to a Supreme Court order, two retired judges — Justice Indrajit Chatterjee and Justice Siddhartha Chatterjee — who had been functioning as administrators of La Martiniere schools, will no longer be required to take on this responsibility. The division bench of Justice Sanjay Kishan Kaul and Justice K M Joseph has directed the case should be referred back to the single bench of Justice Arindam Sinha, where it was initially being heard.
The SC has upheld the judgement of Justice Sinha that the present board of governors will not take any fresh decisions regarding functioning of the school and will not call any meeting of the board of governors.
There is a face-off between the present and the former board with the two challenging each other in court. Four members of the old board, Anil Mukherji, Anjali Das, Gerry Arathoon and Suchitra Guha were removed by the two permanent members, Paritosh Canning, bishop of CNI’s Kolkata diocese, and Swarup Bar, the priest of St Andrew’s Church, on the grounds that they were not inducted properly. The four challenged this in High Court.
Justice Sinha passed his order on July 12. It was challenged in a division bench that appointed the administrators, and finally, in the SC. Hearing will start afresh at the HC after the Pujas.
